Terms of Service

These Terms of Service ("Terms") are a contract between you and Wildcards ApS (doing business as NoFunnyBusiness.ai, "NoFunnyBusiness," "we," "us," or "our"). By using our website or Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Eligibility

You must be at least 18 years old to use the Services.

2) The Services

We provide:

  1. a free initial scan with high-level scores and general findings, and
  2. paid audits delivered by email (typically within 72 hours), based on packages recommended after your free scan.

Our audits may use automation and AI-assisted drafting to produce clearer reports faster, based on information you provide and publicly available business information (like your website and public listings). We also do human review and quality checks.

We may also offer optional help implementing improvements ("Implementation Help") when we can support your website platform or access method. Implementation Help is optional and may be offered separately.

We may change or discontinue any part of the Services at any time.

3) What we need from you

You agree to provide accurate, current information (e.g., your website URL and business listing link) and to respond if we need clarification to complete your audit.

4) Payments, taxes, and delivery

  • Payments are processed through Stripe.
  • Taxes are included in displayed pricing unless we say otherwise.
  • Paid audit deliverables are sent by email to the address you provide, usually within 72 hours (weekends/holidays and complexity may affect timing).

5) Refunds and satisfaction guarantee

Automatic refund if there's nothing meaningful to improve

If, after completing the paid audit, we determine there are no meaningful improvements likely to move the needle within the scope of the package, we will automatically refund your payment.

30-day satisfaction guarantee

You can request a refund within 30 days of payment, no questions asked. Email owner@nofunnybusiness.ai with your purchase details.

(If a payment dispute/chargeback is already in progress, we may pause refund processing until it's resolved.)

6) Implementation Help: you keep the keys

If you choose Implementation Help:

  • You keep the keys. We will not ask for or require your master passwords.
  • When access is needed, we'll ask you to grant limited access (for example, a collaborator account, a temporary password, or screen-share guidance).
  • You are responsible for maintaining the security of your accounts and for removing access when the work is complete.

7) Acceptable use

You agree not to:

  • attempt to hack, disrupt, overload, or reverse-engineer the Services
  • use automated means to abuse forms or scan endpoints (reasonable crawling of our public pages is fine)
  • access or attempt to access non-public areas without permission
  • use the Services for unlawful activity
  • use the results to defame, harass, or target any person or business
  • misrepresent our work as a "Google guarantee," endorsement, or official certification

8) Ownership and licenses

Your data

You own your underlying business data and content.

Our materials

We own our site, branding, templates, methods, scoring models, and report formats (including all intellectual property in them).

License to use your report

When you purchase an audit, we grant you a limited, non-exclusive, non-transferable license to use the report internally for your business purposes. You may not resell or publish it as a competing product.

Improvements from anonymized data

You agree we may use anonymized and aggregated scan/audit data to improve our systems and Services.

Client name/logo

We will not use your name, logo, or identifiable results as a public example unless you give explicit permission in writing.

9) Third-party services

Our Services may rely on third-party services such as Cloudflare, Google services (Analytics/Ads/Tag Manager/Places), PostHog, and Stripe. Your use of those services may be governed by their own terms and policies. We are not responsible for third-party services we do not control.

10) Disclaimers (important)

WE DO OUR BEST WORK, BUT YOU AGREE THE FOLLOWING:

  • OUR SCANS AND AUDITS ARE INFORMATIONAL AND REFLECT OUR BEST ASSESSMENT BASED ON THE INFORMATION AVAILABLE AT THE TIME.
  • WE DO NOT GUARANTEE SPECIFIC RANKINGS, LEADS, REVENUE, AI RECOMMENDATIONS, OR OUTCOMES.
  • WE ARE NOT PROVIDING LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE.
  • SEARCH PLATFORMS, AI SYSTEMS, AND LISTING PROVIDERS (LIKE GOOGLE) CAN CHANGE THEIR RULES AND BEHAVIOR AT ANY TIME, AND WE DON'T CONTROL THEM.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • NOFUNNYBUSINESS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in that case, those limitations apply to the maximum extent permitted.

12) Indemnification

You agree to indemnify and hold harmless NoFunnyBusiness from claims arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party rights.

13) Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or misused the Services.

14) Privacy

Our Privacy Policy explains how we collect and use information. By using the Services, you agree to the Privacy Policy.

15) Governing law

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules.

16) Dispute resolution (arbitration; small claims option)

Informal resolution first

Before filing a claim, you agree to email us at owner@nofunnybusiness.ai and give us a reasonable chance to resolve the issue.

Binding arbitration

If we can't resolve it informally, you and we agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules.

Small claims option

Either party may bring an eligible claim in small claims court instead of arbitration.

No class actions

Disputes must be brought on an individual basis. You and we waive the right to participate in class actions or class arbitrations.

17) Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version. If changes are material, we'll take reasonable steps to notify you (for example, by posting on the site).
